These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Candor ("Candor," "we," "us," or "our"), governing your access to and use of the Candor deception analysis API, website, and related services (collectively, the "Service").
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
Candor provides a linguistic analysis API that evaluates written text for probabilistic indicators of deception. The Service uses computational natural language processing techniques grounded in peer-reviewed research to generate deception likelihood scores and signal breakdowns.
Candor's analysis outputs are probabilistic estimates only. They are not legal determinations, forensic findings, or definitive conclusions about any individual's truthfulness. See our Accuracy Disclaimer for important limitations.
Access to the Candor API is subject to the following terms:
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. The following uses are expressly prohibited:
Candor reserves the right, at its sole discretion, to suspend or terminate your access to the Service, with or without notice, for any of the following reasons:
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) shall survive.
All content, software, algorithms, models, and materials comprising the Service are owned by Candor or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in the Service.
You retain ownership of the text you submit. By submitting text, you grant Candor a limited, non-exclusive license to process that text for the purpose of providing the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.
CANDOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. ANALYSIS RESULTS ARE PROBABILISTIC ESTIMATES AND MAY BE INCORRECT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CANDOR'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO CANDOR IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).
IN NO EVENT SHALL CANDOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).
You agree to indemnify, defend, and hold harmless Candor, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
Candor may update these Terms from time to time. We will post the revised Terms on this page with an updated effective date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Service.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and Candor regarding the Service and supersede all prior agreements.
